This Privacy Policy is applicable to all the information collected by CapSpecialty from you during your use of the website https://www.CapSpecialty.com and any other websites, mobile apps, or other online products and services that display or link to this Privacy Policy (collectively the “CapSpecialty Websites”). This Privacy Policy does not apply to:

  • Websites, mobile apps, or other products and services that have their own privacy statement or policy.
  • Website, mobile apps, or other products and services that do not display or link to this Privacy Policy.
  • Information collected offline.

By using the CapSpecialty Websites, you consent to the collection and use of your personal information by CapSpecialty, as set forth in this Privacy Policy. CapSpecialty reserves the right to change the policy from time to time. If CapSpecialty does decide to change this Privacy Policy, such changes will be posted on the CapSpecialty Websites. Your continued access and use of the CapSpecialty Websites shall be deemed your acceptance of any changes and the reasonableness of these standards for notice of changes.

Collecting Information to Conduct Business

We collect, retain, and use information about you for the purpose of serving your insurance needs and administering our customer relationships. This information is collected in a number of ways, including exchanges of correspondence, by phone, or by personal contact. We may collect nonpublic personal financial information about you from the following sources:

  • Information included on your applications or other forms (such as name, address, and Social Security number);
  • Information about your work and educational history, and other information that you choose to provide us in connection with a job application;
  • Information about your transactions with us or our affiliates (such as services purchased and payment history);
  • Information from consumer reporting agencies (such as credit relationships and history);
  • Information from other sources (such as motor vehicle reports, medical information, and demographic information); and
  • Information from visits to CapSpecialty Websites.

Information Use

We will not sell, share, or rent the information to others. We will use the information that has been voluntarily provided by visitors to improve the content of our website and to contact visitors for marketing purposes. This information will not be shared with other organizations.

CapSpecialty may use your information to better understand your needs, to provide you with the appropriate insurance policy, or improve the quality of our products and services. The CapSpecialty Websites may also contain optional surveys and questionnaires asking for information. Taking part in any of these segments is generally optional. At a minimum, we will always give you the opportunity to opt out of receiving such direct marketing or market research contact.

Persons who supply us with their telephone numbers online may receive telephone contact from us with information regarding their online information requests.

Some of our applications and mobile applications may have location-based features. To deliver these features, CapSpecialty may access and use location data provided by your mobile device, if you give us permission. Location information will be collected solely to deliver the requested feature, and it will not be further retained or stored by us.

CapSpecialty may also use your information for analysis and research, including assessing trends, usage, advertising-related services, as well as developing, delivering, maintaining, improving, and enhancing the CapSpecialty Websites and Services we provide.

CapSpecialty may use the information we collect and publicly available information to help train our artificial intelligence systems or some equivalent machine-based learning (“AI Systems”) for the purposes outlined in this Privacy Policy, affiliated policy, or by agreement. These AI Systems may be used to provide Services. CapSpecialty will comply will all applicable laws and regulations governing the use of AI Systems.

Other Information CapSpecialty Collects and its Use

CapSpecialty may gather and store aggregate information about visitors to our websites. The collection of this information allows us to measure the number of visitors to portions of the CapSpecialty Websites, diagnose problems with the server, administer the CapSpecialty Websites, and track visitor activity. CapSpecialty may use this information to learn more about what our customers are expecting from us and improve the CapSpecialty Websites. This information is not personally identifiable to you, therefore, CapSpecialty reserves the right to use this information for any purpose and share this information with third parties for any purpose. Such ways in which CapSpecialty may collect this information are:

  • HTTP cookies, flash cookies, or other similar technologies. Cookie usage is not linked to personally identifiable information. Customers may configure their browsers to reject cookies and still access the CapSpecialty Websites.
  • Pixel-tags, web beacons, clear GIF’s, or other similar means. The data collected includes what operating system or browser you use, how you navigate to and through the CapSpecialty Websites, and how long you stay on any CapSpecialty Website.
  • Internet Protocol (IP) address.

CapSpecialty may also use service providers to help us develop websites and mobile applications. These service providers may use tracking pixels, agents, or other visitor identification technology to collect certain non-personal information, such as browser type, operating system, and other information that does not personally identify you. These service providers may also collect unique device IDs from mobile devices, mobile phone numbers, precise geo-location data, and call logs.

Some web browsers may transmit “do-not-track” signals to websites which the browser communicates. As of the Effective Date of this Privacy Policy, an industry standard has not yet been established on how to respond to these signals. Therefore, CapSpecialty does not currently respond to these signals, but we may reassess our response approach if a standard is established.

Sharing Information Among CapSpecialty and its Companies

To the extent permitted by law, CapSpecialty may disclose the previously described information about our customers and former customers to other CapSpecialty companies so that they can provide services or account maintenance, and for any other purposes permitted by law. Employee access to customer personal information is authorized for business purposes only. We restrict access to nonpublic personal financial information about you to those employees who need to know such information in order to provide services to you. Employees who have access to customer information are required to protect it and keep it confidential.

Sharing Information with Third Parties

We are highly selective in choosing vendors and service providers that assist us in providing quality insurance services to our customers. We may share certain customer information with these third parties to facilitate the offering, administration, and delivery of these services under controlled circumstances designed to protect our customers’ privacy. CapSpecialty will not otherwise share your personal information with third parties unless you have granted us permission to do so.

We may, in compliance with state and federal laws, disclose nonpublic personal information about you to the following types of third parties:

  • Financial service providers (such as insurance producers and reinsurance companies);
  • Companies that perform services for us or on our behalf such as
    • Vendors we hire to respond to customer requests;
    • Vendors that maintain or develop software for us;
    • Website hosting or information technology consulting service providers;
    • Marketing and promotion service providers;
    • Data analytic service providers;
    • Legal service providers;
    • Accounting service providers;
    • Administrative service providers;
    • Information security service providers; and
    • Application service providers.

We require third parties to comply with strict standards regarding security and confidentiality of your information. They are not permitted to release, use for their own purposes, or sell any customer information we share with them to any other party. Additionally, there may be occasions when we are legally required to disclose information about you to nonaffiliated third parties. For example, we may disclose information in response to a subpoena, to prevent fraud, or to comply with a legally permitted inquiry by a governmental agency or regulator.  In addition, CapSpecialty reserves the right to cooperate with law enforcement authorities in investigating and prosecuting customers and insurance producers who violate our rules or engage in behavior that is illegal or harmful to others or their property.

Online Payments

The CapSpecialty Websites may allow you to pay insurance premiums or other charges due to CapSpecialty at various times. CapSpecialty may utilize third party payment processors to process your payment. However, CapSpecialty cannot be responsible for transactions handled by the third-party provider including your credit card account number, or any other information that you share with this provider to make a payment. As set forth in the CapSpecialty Terms and Conditions, CapSpecialty specifically disclaims liability for any transactions occurring with this third-party provider.

Social Media

CapSpecialty maintains profiles or pages on various social media sites including Instagram, LinkedIn, X (formerly Twitter), and YouTube. If you choose to “Follow” CapSpecialty on Instagram, LinkedIn, X, or YouTube, or take any similar action on another social media site, you are providing your consent to receive information updates from CapSpecialty. To stop receiving this information from CapSpecialty on a social media site, you must follow the procedure established by the site, such as click “Unfollow” on CapSpecialty’s page on Instagram, LinkedIn, X, or YouTube.

Links to Other Websites

The CapSpecialty Websites may contain links to other websites. The operators of those other websites may collect information about you, through cookies or other technologies. If you link to another website, you will leave the CapSpecialty Websites and this Privacy Policy will not apply to your use of and activity in those other websites. If you provide personal information through any other website, your transaction will occur on that website and the personal information you provide will be collected and controlled by the privacy policy of that website operator. Links to these websites are provided as a convenience and should not be implied as an endorsement of the linked website. CapSpecialty has no responsibility or liability for your access or use of, and the data collection and use practices of the other websites.

Children’s Privacy

CapSpecialty does not knowingly collect or use any information from children, defined as minors younger than 13, on the CapSpecialty Websites. CapSpecialty does not knowingly allow children to order our products or services, communicate with us, or use any of the CapSpecialty Websites. California legislation requires that certain disclosures be made available to California residents who provide information over the internet that is used for direct marketing purposes. CapSpecialty takes reasonable precautions to safeguard the personal information transmitted via the CapSpecialty Websites and the personal information stored on our servers, and we require third parties with whom we share personal information to use reasonable precautions to safeguard such information. Artificial Intelligence

In an effort to increase efficiency and improve our level of service, CapSpecialty may use artificial intelligence systems or some equivalent machine-based learning (“AI Systems”). These AI Systems related to submission intake may be used to assist in the handling of your business. Underwriting decisions are not made by AI Systems. CapSpecialty’s use of these AI Systems will not replace the good faith, equitable consideration given to each account by CapSpecialty underwriters but rather will be used to supplement it. Additionally, CapSpecialty will comply with all applicable laws and regulations governing the use of these AI Systems.

Changes to Policy
