Capitol Specialty Insurance Corporation (“CSIC”) operates as a surplus lines insurer in all states and D.C. Surplus lines insurers are known as “nonadmitted” insurers because they are not licensed in the state where the insured or risk is located, although they accept business from licensed surplus lines producers, which are located in such states. Surplus lines insurers are generally regulated for solvency and must be authorized in their state of domicile. CSIC’s products are available only through appropriately licensed surplus line producers. U.S. risks placed with a surplus lines insurer must be placed in accordance with the applicable surplus lines laws and certain applicable laws. Surplus lines insurers do not generally participate in state guaranty funds and insureds are not generally protected by such funds. The surplus lines market provides flexibility in rate and form to meet customer needs for high risk and specialized insurance products.
